GENERAL INFORMATION
These General Terms and Conditions of Sale govern the purchase of products from Cereria San Giacomo s.a.s. carried out remotely via the telematic network on the website Candele.it, owned by Cereria San Giacomo s.a.s., with registered office in Romano d'Ezzelino, Via S.G.B. La Salle, 15 – 36060. Each purchase transaction shall be governed by the provisions of Legislative Decree 185/99 and Legislative Decree 206/05; the information aimed at concluding the contract shall be subject to Article 12 of Legislative Decree 70/03 and, with regard to privacy protection, shall be subject to Legislative Decree 196/03.
CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE
Sales contracts for products on the Candele.it website are considered concluded at the moment the purchase order placed by the customer is received by Cereria San Giacomo s.a.s. and accepted by the latter. Cereria San Giacomo s.a.s. will promptly send the customer a receipt of the purchase order. By electronically submitting their purchase order, the customer declares that they have read and accepted these general contract conditions and undertakes to observe and comply with them in their dealings with Cereria San Giacomo s.a.s.
PROCESSING OF PERSONAL DATA
Cereria San Giacomo s.a.s., pursuant to Article 13 of Legislative Decree 196/2003, informs that personal identification and tax data acquired also verbally in relation to established commercial relationships, provided directly by the interested parties or otherwise acquired in the course of the company’s activity, shall be processed in compliance with the aforementioned regulations, including the confidentiality obligations provided therein. In relation thereto, the rights referred to in Article 7 of Legislative Decree 196/2003 may be exercised.
CUSTOMER OBLIGATIONS
The Customer is required, before submitting their purchase order, to carefully read these general terms and conditions of sale. Submission of the purchase order implies full knowledge and acceptance thereof. The Customer is also required, once the online purchase procedure has been completed, to print and keep these general terms and conditions of sale, already viewed and accepted during the contract conclusion phase.
ORDER DEFINITION
By submitting an online order, the Customer sends Cereria San Giacomo s.a.s. a purchase proposal for the product(s) placed in the shopping cart. When the Customer places an online order for the products in the cart, they agree to purchase them at the price and under the terms indicated in these General Terms and Conditions of Sale.
Cereria San Giacomo s.a.s. will notify the Customer of the acceptance and confirmation of the order.
PURCHASE METHODS
The customer purchases the product, whose characteristics are illustrated online in the relevant descriptive and technical sheets, at the indicated price, to which delivery costs specified on the website are added. Before submitting the purchase order, the unit cost of each selected product, the total cost in the case of purchasing multiple products, and the related delivery costs are summarized. Once the purchase order has been submitted, the customer will receive an email message from Cereria San Giacomo s.a.s. confirming receipt of the purchase order and containing information regarding the main characteristics of the purchased item, a detailed indication of the price, delivery costs, applicable taxes, payment methods, and a reference to the general contract conditions and information regarding the existence of the right of withdrawal, its conditions, and methods of exercise displayed on the website. Following the approval of Legislative Decree no. 223 of 4 July 2006 (“manovra bis”), Article 37 paragraphs 8 and 9, converted into Law 248 of 4 August 2006, effective from 12 August 2006, which reinstated the obligation to communicate customer and supplier lists in the case of invoice issuance, and Legislative Decree 78 of 31 May 2010 converted into Law 122 of 30 July 2010, customers are required to provide VAT number and tax code in the appropriate fields on the website.
PAYMENT
The customer may make payment using one of the following methods.
Credit card payment: If the consumer intends to make payment by credit card, they may use the PayPal payment procedure, which ensures the confidentiality of the data provided by customers. For further information and additional Legal Agreements, customers are invited to consult the website www.paypal.com.
Bank transfer payment: Payment by bank transfer can be made using the following details:

If payment is made by bank transfer, the purchased item will be shipped according to the methods described in the following paragraph “Delivery of Products” to the address indicated by the customer upon receipt of the payment, generally within two to five days after the transfer is made (timing varies depending on the credit institution used). To facilitate processing, a copy of the payment receipt together with the order number may be sent by email to: servizioclienti@Candele.it
DELIVERY OF PRODUCTS
The purchased item is delivered by courier to the address specified by the Customer at the time of the online order. Any specific requirements must be communicated by the customer to Cereria San Giacomo s.a.s.. In the event of failed delivery due to the recipient’s absence at the indicated address, the courier will leave a notice and attempt delivery a second time; if the recipient is still absent, the goods will be returned to the sender (Cereria San Giacomo s.a.s.).
LEGAL WARRANTY OF CONFORMITY AND DEFECTIVE PRODUCTS
For the purposes of this contract, consumer goods are presumed to be in conformity with the contract if, where relevant, the following circumstances coexist:
a) they are fit for the purposes for which goods of the same type are normally used;
b) they conform to the description given by the seller and possess the qualities of the goods that the seller presented to the consumer as a sample or model; c) they show the quality and performance normal for goods of the same type, which the consumer can reasonably expect, taking into account the nature of the goods and, where applicable, public statements on the specific characteristics of the goods made by the seller, producer, or their agent or representative, particularly in advertising or labeling;
d) they are also fit for the particular purpose desired by the consumer and made known to the seller at the time of contract conclusion, and accepted by the seller, even implicitly. The consumer loses all rights if they do not report the lack of conformity to the seller within two months from the date on which the defect was discovered. Notification is not necessary if the seller has acknowledged the defect or concealed it. In any case, unless proven otherwise, defects of conformity that appear within six months from delivery are presumed to have existed at that time, unless this presumption is incompatible with the nature of the goods or the defect. In the event of lack of conformity, the consumer may request, alternatively and without charge, under the conditions indicated below, repair or replacement of the purchased goods, a price reduction, or termination of this contract, unless the request is objectively impossible or excessively burdensome for Cereria San Giacomo s.a.s. pursuant to Article 130, paragraph 4, of the Consumer Code.
